Subject: Payment of Dearness Allowance to Gramin Dak Sevaks (GDS) at revised                  rates w.e.f. 01.07.2011 onwards-reg.

            Consequent upon grant of another installment of Dearness allowance , with effect from 1st July, 2011 to the Central Government Employees vide Government of India , Ministry of Finance , Department of Expenditure, OM No. 1(14)/2011-E-II(B) dated 3rd October,2011, the Gramin Dak Sevaks(GSD) have also become entitled to the payment of dearness allowance on basic TRCA at the revised rate with effect from 01.07.2011. It has, therefore, been decided that the dearness allowance payable to the Gramin Dak Sevaks shall be enhances from the existing rate 51% to 58% on the basic Time Related Continuity Allowance with effect from the 1st July, 2011.

2.         The additional installment of dearness allowance payable under this order, shall be paid in cash to all Gramin Dak Sevaks. The payment of arrears of dearness allowance for the months of July to September, 2011, shall not be made before the date of disbursement of TRCA for the month of September, 2011.

3.         The expenditure on this account shall be debited to the Head" Salaries" the relevant head of account and should be met from the sanctioned grant.

4.         This issues with the concurrence of Integrated Wing vide their Dairy No. 123/FA/II/CS dated 18th October, 2011.

STRENGTHENING OF VIGILANCE SET-UP IN MINISTRIES/DEPARTMENTS

OFFICE MEMORANDUM

Subject: Strengthening of Vigilance set-up in Ministries/Departments.

            The Government had constituted a Group of Ministers (GoM), on 6th January, 2011 with the approval of the Prime Minister to consider measures that can be taken by the Government to tackle corruption. One of the terms of reference (ToR) of the GoM was to consider and advise on 'Fast tracking of all cases of public servants accused of corruption ". The GoM, while considering this (ToR) also considered certain important recommendations of the Hota Committee (Committee of Experts to review the procedure of Disciplinary/Vigilance Inquiries and recommended measures for their expeditious disposal) has made a recommendation that vigilance administration of the Central Ministnes/Departments may be strengthened.

            This recommendation of the GoM has been accepted by the Government. Accordingly, and all Ministries/Departments are advised to strengthen their vigilance administration with requisite manpower with a view to ensuring expeditious disposal of disciplinary cases. The Ministries/Departments may, where appropriate, consider setting up of a monitoring cell to review and monitor the progress of all pending Disciplinary Inquiries on a day-to-day basis, with a view to ensuring their timely conclusion.

DISPENSING WITH SECOND STAGE CONSULTATION WITH THE CVC IN DISCIPLINARY CASES

Subject: Dispensing with second stage consultation with the CVC in disciplinary cases.

            The Government had constituted a Group of Ministers (GoM), on 6th January, 2011 with the approval of the Prime Minister to consider measures that can be taken by the Government to tackle corruption. One of the terms of reference (ToR) of the GoM was to consider and advise on "Fast tracking of all cases of public servants accused of corruption '. The GoM, while considering this (T0R) also considered certain important recommendations of the Hota Committee (Committee of Experts to review the procedure of Disciplinary/Vigilance Inquiries and recommended measures for their expeditious disposal) and decided that second stage consultation with CVC in disciplinary matters may be dispensed with. However, in those cases where consultation with UPSC is not required as per extant rules/instructions, the second stage consultation with CVC should continue.
The above recommendation of the GoM has been accepted by the Government with the approval of the Prime Minister. All Ministries/Departments are, therefore, advised to strictly adhere to the new procedure with immediate effect.

            The Central Vigilance Commission has been separately requested to amend its Vigilance Manual and other relevant instructions accordingly.

APPOINTMENT OF INQUIRY OFFICERS (IOS) AND PRESENTING OFFICER (POS) IN DISCIPLINARY CASES

Subject: Appointment of Inquiry Officers (IOs) and Presenting Officer (POs) in                           disciplinary cases.

            The Government had constituted a Group of Ministers (GoM) on 6th January, 2011 with the approval of the Prime Minister to consider measures that can be taken by the Government to tackle corruption. One of the terms of reference (ToR) of the GoM was to consider and advise on 'Fast tracking of all cases of public servants accused of corruption ". The GoM, while considering this ToR also considered certain important recommendations of the Hota Committee (Committee of Experts to review ¡he procedure of Disciplinary/Vigilance Inquiries and recommend measures for their expeditious disposal) and recommended that Departments/Ministries should primarily use serving officers as IOs & POs and that in important cases, they may request CVC to appoint their CDI as IO. The GoM has also recommended that the CVC may also maintain a panel of IOs/POs from amongst retired officers, whose services can also be utilized by various Ministries/Departments.

            The above recommendations of the OM have been accepted by the Government and accordingly all Ministries/Departments are advised to use serving officers as IOs & POs and in important cases, request the CVC to appoint their CDI as IO. They may also, in appropriate cases, utilize the services of IOs/POs who would be available on the panel to be maintained by CVC, in consultation with CVC.

GRANT OF DEARNESS RELIEF TO CENTRAL GOVERNMENT PENSIONERS/FAMILY PENSIONERS - REVISED RATE EFFECTIVE FROM 1.7.2011

Subject: Grant of Dearness Relief to Central Government pensioners/family      pensioners - Revised rate effective from 1.7.2011.

            The undersigned is directed to refer to this Department's OM No. 42/15/2011-P&PW(G) dated 29th March, 2011 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief (DR) payable to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 51% to 58% w.e.f. 1st July, 2011.

2.         These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners and (V) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. In terms of this Department's OM No. 23/1/97-P&PW(B) dated 23.2.1998 read with this Department's OM No. 23/3/2008-P&PW(B) dated 15.9.2008.

3.         Central Government Employees who had drawn lumpsum amount on absorption In a PSU/Autonomous body and have become eligible to restoration of 1/3 commuted portion of pension as well as revision of the restored amount in terms of this Department's OM No.4/59/97-P&PW (D) dated 14.07.1998 will also be entitled to the payment of DR @ 58% w.e.f. 1.7.2011 on full pension i.e. the revised pension which the absorbed employee would have received on the date of restoration had he not drawn lumpsum payment on absorption and Dearness Pension subject to fulfillment of the conditions laid down in para 5 of the O.M. dated 14.07.98. in this connection, Instructions contained in this Department's OM No.4/29/99-P&PW (D) dated, 12.7.2000 refer.

4.         Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

5.         Other provisions governing grant of DR In respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained In this Department's OM No. 45/73/97-P&PW (G) dated 2.7.1999 as amended vide this Department's OM No. F. No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension , will remain unchanged.

6.         In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.

7.         t will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.

8.         The offices of Accountant General and Authorised Public Sector Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, 11/34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (II) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.

9.         In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders Issue after consultation with the C&AG.
10.       This issues with the concurrence of Ministry of Finance, Department of Expenditure conveyed vide their OM No. 1(4)/EV/2004 dated 5th October, 2011.

GRANT OF SPECIAL ALLOWANCE FOR CHILD CARE FOR WOMEN WITH DISABILITY

Sub: Grant of Special Allowance for child care for women with disability.

The undersigned is directed to refer to this Department's O.M. No.12011/04/2008-Estt.(AL) dated 11th September, 2008 on the above subject and to state that this Department has been receiving references from various Departments seeking further clarifications. The doubts raised are clarified as under:


(i) Whether the women employees with disabilities shall be entitled for allowance at double the rates for multiple births at the time of first child birth?
No. In case of multiple births at the time of first child birth, the woman employee shall not be entitled to this allowance at double the rate for multiple births.
(ii) Whether the allowance would be admissible for the 3rdchild in case first two children i.e. if the first child (or for that matter the 2nd child) expires before the attaining the age of two years.
It is clarified that the grant of Special Allowance for child care for women with disabilities is admissible for two years from the birth of the child so long as the woman employee does not have more than two surviving children.

SB ORDER NO. 20/2011 - Removal of Maximum limit Balance in SB Accounts- Important Amendments

Subject:- Removal of ceiling of maximum balance to be retained in a post office savings account- amendment to Rule-4 of the Post Office Savings Account Rules 1981 regarding.

Sir / Madam,

The undersigned is directed to say that issue of removal of ceiling of Rs.1 lac in single savings account and Rs.2 Lac in Joint Savings Account fixed in the year 2000 was under consideration in the Min. of Finance (DEA). This issue was linked to the benefit of exemption in Income Tax on the interest earned in Post Office Savings Account under Section10(15) (i) of Income Tax Act, 1961 by the CBDT and Min. of Finance (DEA). After sustained efforts on the part of this Directorate, Min. of Finance (DEA) has now amended Rule-4 of the Post Office Savings Account Rules 1981 vide G.S.R.681(E) F.No.2/5/2006-NS-II dated 15.9.2011 (copy enclosed). Some major benefits of this amendment are given below:


(i) From 1.10.2011, there will be no limit for retaining balance in single as well as joint savings account.

(ii) A depositor or depositor(s) can deposit any amount into single as well as joint savings account.

(iii) Maturity value of any savings instrument can be credited into savings account of the depositor standing in the same post office irrespective of the balance in the account.

(i) Any cheque either issued by Postmaster or any other authority irrespective of any amount can be credited into post office savings account irrespective of the balance in the account.

(ii) From the Financial year 2011-12, Interest income of Rs.3500/- in the case of single account and Rs.7000/- in case of Joint account will be exempted from Income Tax. (Section 10(15) (i) of Income Tax Act, 1961 amended vide Notification No. 32/2010 {F.No. 173/13/2011-IT A.I}/S.O.1296(E) dated 03.06.2011)

(iii) It is the duty of the depositor(s) to show the interest income earned from Post Office Savings Account(s) beyond the limit prescribed above in the Income Tax return and pay due Income Tax.

1. It is requested that all field units may be directed to give wide publicity to these changes in the shape of Public Notice and printing of leaflets.

2. This issues with the approval of DDG(FS).
